Sign-Up Fee: A one (1) time fee paid at sign-up or re-join. Sign-Up Fee may paid with credit card, debit card, cash, or check. Sign-Up Fee is a per member fee.
Monthly Fee: Monthly Fee must be drafted via ACH (checking or savings account using ABA routing code and account number). At sign-up, a pro-rated portion
of the monthly fee must be paid along with the sign-up fee and keyfob/RFID fee.
Keyfob (RFID) Fee: Cost recovery fee for keyfob (RFID) to allow member access to facility during both staffed and un-staffed hours. This cost may change based
on our cost to acquire, inventory, issue, and replenish keyfobs (RFID). Only ONE (1) keyfob (RFID) per member, each member must have their own keyfob
(RFID). Under NO conditions is keyfob (RFID) to be shared, even with a current member! Each and every member must have their own keyfob (RFID) issued by
Gymies Health & Fitness Club, Inc./Gymies Fitness Center. To attempt to share a keyfob (RFID) is stealing/theft and may result in being assessed, without notice,
a fee of $50 to $100 and may be subject to immediate termination of membership with NO reimbursement and/or possible criminal prosecution as well as recovery of
damages and/or costs and any attorney's fees.
Fee for Replacement of Keyfob (RFID): Replacing lost/misplaced/destroyed/inoperable keyfob (RFID) must be done during staffed hours. Photo identification
must be brought in at the time as well as the cost of replacement keyfob (RFID) paid at the time of issuing replacement keyfob (RFID).
Draft Date: The date monthly fees are drafted is the 15th. If the 15th is a non-banking business day, draft will occur the first banking business day AFTER the 15th.
The draft date is never executed early!
Returned Drafts: Drafts returned for any reason are added to the next draft, plus a $15 cost recovery fee. The second consecutive draft returned may be turned
over for legal collection with costs being the responsibility of the member/buyer. Returned drafts may be paid in person at least 15 days prior to draft date to prevent
the returned draft being added to the upcoming draft. If the draft is returned due to closed account, a closed account fee of $39, or greater, will be due and use of
membership may restricted until valid account information is given with payment for the closed account fee and returned draft.
Drafts Past Cancellation: We go to GREAT lengths to be sure we don't make a mistake in regards to membership cancellation! Petition for reimbursement for
drafts past effective cancellation date must be submitted in writing at facility or mailed via certified U.S. Mail. Any and all documentation must be submitted with
written petition. Management will have thirty (30) days to investigate and act upon petition for reimbursement. If management determines that written notice to cancel
conforms to requirements, a refund check will be mailed within ten (10) days. If management determines that written notice to cancel did not conform to
requirements, no refund will be given.
Rate Change: Advertised/published rates are changed WITHOUT notice. Once a membership is purchased, the monthly rate may be changed with thirty (30) day
written notice either by email or US First Class mail. Actual receiving of rate change notice is not guaranteed. If you object to the rate increase, you must submit
your written objection within seven (7) business days and your membership will be cancelled before the draft date and use of facility will be terminated at the
expiration of membership. Rejoin will be necessary if you wish to restart/resume membership, under the terms for rejoining.
Family members and/or significant other: Family members must live in the same residence and have the same legal address. Gymies Health & Fitness Club,
Inc/Gymies Fitness Center reserves the right to require independent proof and verification. Children must be between 13 and 22 years of age and live in the same
residence, and have the same legal address, as parent/primary member. Gymies Health & Fitness Club, Inc/Gymies Fitness Center reserves the right to refuse
family membership to any member or persons. Refusal to sell membership will be made at the sole discretion of management of Gymies Health & Fitness Club, Inc.
/Gymies Fitness Center.
Security Cameras: For the security of the facility and members, we have 32 high-definition digital security cameras that are placed through out the facility, where
allowed by law. Absolutely NO security cameras are in the locker rooms or tanning rooms. The high-definition digital security cameras record constantly to our
network video recorder. Video may be permanently archived and may be used in legal proceedings, both civil and/or criminal. Resistance training room (front main
room), cardio room, group fitness room, all hallways, office, nursery/kid room, entry door, and emergency exit doors are all under constant and continuous high-
definition digital security camera surveillance. Most areas, especially critical areas, are monitored simultaneously by multiple high-definition digital security cameras
from multiple angles/views. High-definition digitally recorded video is reviewed for compliance with rules and policies by members.
Use/Non-Use/Misbehavior: Primary member and additions to membership may use any and all fitness and workout areas excluding tanning bed. All members
agree to abide by all rules and staff. Use of foul language is prohibited. Abuse of equipment or any part of the facility is prohibited. Harassment of any form is
prohibited. All illegal activities are prohibited. Failure to follow any rules may result in member being denied access to facility until an agreement and/or settlement of
issue/problem is completed. Member acknowledges that no compensation or reimbursement or damages will be given during any suspension due to member
misbehavior or alleged misbehavior. Failure to use the membership by any or all members does not constitute cancellation or forgive the requirement that monthly
fees be paid until cancellation requirement is met, regardless of the duration of non-use.
What is a membership?: A membership is a legal right to use, regardless of actual use and/or non-use. In other words, you have the legal right, if you so choose,
to use your membership while it is valid. If you do not use, or freely choose not to use, your membership while it is valid, you still had the legal right to use it. That is
what you purchase with a membership - the legal right to use - it is not a per use or a specified quantity of use. While your membership is valid, you have legal right
to unlimited use of your membership. Unlimited does not specify a maximum or a minimum quantity.
Cancellation: A written thirty (30) day notice to cancel is required. Receipts for all notices is given at the time written notice is submitted in person at facility. Written
thirty (30) day notice to cancel may be mailed via certified U.S. Mail. Please retain all receipts for your future reference. Once written thirty (30) day notice is
submitted, all members may continue to use membership as usual until the 14th of the month at which time all use of membership and rights of use with membership
is cancelled and no longer valid. Continued use may be gained by paying a single visit fee with each use or re-joining under the terms for re-joining. Keyfob (RFID)
and the fee for the keyfob (RFID) is not returnable or refundable under any circumstance. Minimum term memberships must be for the minimum term, thereafter are
month-to-month with thirty (30) day written notice to cancel.
Transfer: Memberships are not transferable. Written request for an exception may be made, but the decision is made at the sole discretion of management on a
case by case basis.
Pausing Membership: Memberships are continuous and cannot be paused. Written request for an exception may be made, but the decision is made at the sole
discretion of management on a case by case basis.
Re-Joining: Once membership is cancelled, membership can be re-started by two different means. One, pay all monthly fees between re-join date and cancellation
date. Two, pay the current sign-up fee for the number of members to be on the new membership and the corresponding currently monthly fees.
Equipment Questions: A question on a particular of piece of equipment can be answered at any time provided staff on duty at the time have the time available to
answer the question. If member is unsure of how to use the particular piece of equipment, member should wait until all questions are answered before using the
particular piece of equipment. Questions regarding program design, workout exercises, reps, sets, repetition speed, workout charts, and how to achieve fitness
results meets the requirement of a personal workout program and personal workout program fee. Staff has the final say in whether a particular question(s) meets
the requirement of a personal workout program and fee.
Medical Condition and Member Ability: All members are solely and completely responsible for any and all exercises and movements done at the facility.
Management strongly urges all members to consult with their doctor or health professional before using any part of the facility. Management reminds all members to
work at their own level and abilities and to not perform any exercise or movement they are not fully comfortable or competent to do safely and without injury. All
members agree that no staff or trainer or management has suggested medical treatment or given medical advice. In recognition of the possible dangers connected
with any physical activity, member(s) hereby knowingly and voluntarily waives any right or cause of action of any kind whatsoever arising as a result of such
activity from which any liability may result or accrue to Gymies Health & Fitness Club, Inc/Gymies Fitness Center, it's officers, agents, employees or instructors.
Disclaimer: Gymies Health & Fitness Club, Inc/Gymies Fitness Center urges all members to obtain a physical examination from their physicians prior to the use of
any exercise equipment or attendance in any exercise class. In recognition of the possible dangers connected with any physical activity, member(s) hereby
knowingly and voluntarily expressly forever waives ANY AND ALL right or cause of action of ANY KIND WHATSOEVER arising as a result of such activity from
which ANY liability may result or accrue to Gymies Health & Fitness Club, Inc/Gymies Fitness Center, it's owners, officers, agents, employees or instructors. It is
expressly agreed that ALL exercises and use of ANY and ALL equipment or exercise is done at member’s SOLE RISK. Gymies Health & Fitness Club, Inc/Gymies
Fitness Center, it’s owners, employees, instructors and agents shall be held NOT liable in ANY way for ANY AND ALL claims, demands, injuries, damages, actions
or causes of action whatsoever to member or property of the member or to member’s
family/estate/heirs/relatives/spouse/children/friends/employer/company/employees. Member and member’s
family/estate/heirs/relatives/spouse/children/friends/employer/company/employees expressly and willingly forever releases Gymies Health & Fitness Club,
Inc/Gymies Fitness Center, it’s owners, employees, instructors, and agents from ANY accident or ANY injury and from ALL acts of active or passive or gross
negligence on the part of Gymies Health & Fitness Club, Inc/Gymies Fitness Center, it’s employees, owners, instructors, and agents.
In plain language, member is completely responsible for the member’s own safety while exercising as well as the safe use of any equipment. Gymies Health
& Fitness Club, Inc./Gymies Fitness Center or the employees/instructors are not responsible for any injuries or damages or negligence or what ever you
can name or dream up! Use common sense, know yourself and your limitations, and only do exercises and use equipment that you are completely
comfortable in doing or using. Member is advised and reminded to always work well within the member’s physical ability and to not do any exercise or use
any equipment the member is not completely comfortable in using. This "in plain language" is not meant to replace or take away from "disclaimer" or
"medical condition and member ability", but is our best attempt to plainly summarize them for clarity.
Hours: Staffed hours are posted and will be observed, but are subject to change without notice.
Holiday hours are posted as soon as possible and also are subject to change without notice.
Premium members have access 24 hours a day 7 days a week unless posted otherwise.
Basic members have access during basic membership hours only, subject to holiday blackout dates as specified in price sheet as well as during sign-up. Blackout
dates may be changed without any notice and are subject to adjustment as necessary.
Inclement weather and/or weather disaster may force the closing and restriction of access to facility without notice. Use/access to some, or all, parts of facility may
be restricted during non-staffed hours due to safety of members being the main priority.
Jurisdiction & Other Legal Rights: Gymies Health & Fitness Club, Inc/Gymies Fitness Center reserves all rights under Indiana Law and no rights are waived,
whether written, expressed, or implied. Hamilton County, Indiana will be the sole governing body with exclusive jurisdiction.
data and information is taken seriously and as such we follow industry standards to protect and secure all data. We do not sell or rent your information to any one
under any circumstance. We do not release any data or information to any individual or institution unless written directive with permission by member is received.
The exception to this is to comply with all laws and/or court orders and/or law enforcement.
